By accessing Rafeqi (“the Application”), you confirm your understanding of the Terms & Conditions, and you agree to be bound by these Terms & Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this Application. The Application reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Application with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Application following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes. Please read these Terms carefully before you start to use the Application, as they set out the legal agreement between Rafeqi and the userUser for the use of service.


CHANGES TO THE TERMS OF USE

Rafeqi may, at any time, for any reason and without notice, make changes to (i) this Application, including its look, feel, format, and content, as well as (ii) the services as described in this Application. Any modifications will take effect when posted to the Application. Therefore, each time you access the Application, you need to review the Terms and Conditions upon which access and use of this Application is conditioned. By your continuing use of the Application after changes are posted, you will be deemed to have accepted such changes.

ACCOUNT 

You may need your own Rafeqi account to use certain Rafeqi services, and you may be required to be logged into the account. If you use any Rafeqi service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and your mobile devices, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorized manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information, you have provided.


INTELLECTUAL PROPERTY CLAIMS

Rafeqi respects the intellectual property rights of others. If you believe something on this Application has infringed your intellectual property rights, please notify our agent. 


VIOLATION OF THESE TERMS OF USE 

You acknowledge and agree that the following acts are considered a violation of the terms of use, including but not limited to: 


  1. distributing illegal content that promotes illicit practice or commerce;

  2. publishing fake news and rumors that denigrates someone's public image;

  3. extorting an individual or sharing content that aims for it;

  4. impersonating another individual's identity;

  5. using the application to upload malwares or spread viruses or harmful codes;

  6. representing a foundation or a commission without being entitled to do so;

  7. publishing materials that violate one's intellectual property; and

  8. violating other Users' rights and stealing their accounts

DISCLAIMERS

By using the Rafeqi website/application, the User agrees to the following: 

  1. Rafeqi is a platform that provides services connecting you with licensed veterinarians. The Rafeqi application does not provide veterinary services itself and is not responsible for any veterinary advice or treatment provided through Rafeqi. All veterinary services provided through Rafeqi are subject to the terms and conditions of the veterinarian providing the service, which may include fees, cancellation policies, and other terms agreed upon with the specified vet.

  2. All veterinary advice provided through Rafeqi is provided solely for general informational purposes and is not intended to replace the advice or care that you would receive from your own veterinarian. You should always consult with your regular veterinarian before acting on any veterinary advice provided through Rafeqi.

  3. Rafeqi does not provide any warranties or guarantees regarding the accuracy, completeness, or usefulness of any veterinary advice provided through the Rafeqi application. You use the Rafeqi application and the veterinary services provided through Rafeqi at your own risk.

  4. Rafeqi shall not be held responsible for any loss, theft, or sale of any animal resulting from the use of this platform or any transactions made through it.

  5. Rafeqi is not responsible for any issues that may arise between third parties and Users.

  6. Rafeqi does not endorse or guarantee the quality of service offered by the drivers on its platform, and it does not have control over their actions or behavior. Therefore, Users shall take necessary precautions and exercise due diligence when using our service.

  7. Rafeqi is not responsible for any loss, injury, or damage to animals or property that may occur during the transportation process. 

  8. By using the Rafeqi application, you acknowledge and agree that you have read and understand this disclaimer, and that you accept and agree to be bound by its terms and conditions. If you do not agree to these terms and conditions, you may not use the Rafeqi application or the veterinary services provided through Rafeqi.

  9. Rafeqi reserves the right to change or modify this disclaimer at any time and without prior notice. Your continued use of the Rafeqi application and its veterinary services constitutes your acceptance of any such changes or modifications.

LIMITATION OF LIBALITY

In no event will Rafeqi, or its suppliers, partners, or licensors, be liable with respect to any subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data. Rafeqi shall have no liability for any failure or delay due to matters beyond their reasonable control.


DISPUTE RESOLUTION 

Any controversy, dispute, or claim of any nature arising out of, in connection with, or in relation to the interpretation, performance, enforcement or breach of the agreement made between parties shall be resolved at the written request of any party to the contract by binding arbitration pursuant to the laws of the Kingdom of Saudi Arabia. 

- ⁠Governing Law: these terms and conditions and any dispute or claim arising out of or in connection with these terms and conditions shall be governed by the law of the Kingdom of Saudi Arabia.
